Street was solicitor for plamtifl, and one Newcomb a guardian, ad ltt for infants.

Street claimed the costs ol the guardian ad litem, and this suit seemed to have arisen out of his desire lo get thecnelsol both aides, the mil being a friendly one. Buttolph paid the tobts ol the guardian ad litem, lo Street, and after lerwardsa bond of indemnity was given to Buttolph to save him harmless from the consequencea ot such pament. Jewcorub sued Buttolph and recovered tbe costs, and Buttolph now sues on the bond given by defendant, the brother of William 1. The plaintiff claimed that the recovery bv Ne wcomb worked a forfeiture ot tbe bond of indemnity Defendant contended thai the recovery by ewcomb was solely by reason ot declarations ot Buttolph, lhat he bad the moniea et in bis bands would pay oterto Kewcomb.when iu (act he had previously paid them to Street, and that therelore the recovery ot Newcomb'a was plaintiff's ow fault. Plaintiff denied making such allegations, and contended that if hedid.Newcomb could recover independently from them.

Fisk was en gnged in business, at Ked Hook in becoming embarrassed, be made a transfer ol his stock in trade to Pindar, ho had heretofore been his cleik. The poods were estimated lobe worth about $2000, and the consideration of the transfer consisted of a valid note lor 300 and two sham notes to cover the rest. Creditors of commenced proceedings supplemenrary to execution on iheir judgments, bt tore tbe County Judge to compel a discovery ol his property. The remit of those proceedings was an order made by ibe Judge that tbe plaintiff be appointed receiver, and ordering Fisk to assign hia property to htm. The receiver then brought ibis suit agjinBt Pindar to recover of him the amount of the debts upon which the proceedings supplementary to execution were founded.

On the trial of this suit the plaintiff offered in evidence theordera made by Judge Row ley. by which he was appointed receiver. Tbe drlendant objected to these being read in evidence, and argued that as the County lnrfsp in this matter was an office of snecial luris diction, the plaintiffs should show the existence of judgments ana executions issueu inereon, reiurnea unsatisfied. The plaintiff also offered Flsk and ife as itnesscs, to hich the defendant objected, because FuJs wb the: party for whose immediate benefit the suit was prusecuted, as when a judgment was rendered and collected of Pindar, it would be the payment of Fitk's debt, and that if be could not testify, hia wife was also incompetent. The defendant also contended that one of the orders appointing the plaintiff receiver, was defective on its lace, because it appeared that the execution referred to in it, was returned in thirty days from IhMirae of being issued.

All these points were decided against the defendant, whereupon be accepted and appealed to this Court. The judgment of the Court below was affirmed with costs. A. Wager, for plrl Armstrong and Haight, for deft. SUPREME COURT.

Wo understand that the Fourth of July, was disgraced by the rioting of a large number of voong men. Tallying under various names, at the Rock Spring Gardens, kept by two Germans, on the Frederick road, near Gwyn'a Falls. In the morning there were several fights among drunken parties, and in the afternoon about 5 o'clock a most desperate riot look place, elonea, pistols, and all other kinds of available weapons being used by the participants. The windows, doors, of the house were broken, and all peaceable citizens placed ill dread of their lives. A number of pistols were fired as either party would advance' or retreat, tbe fight being kept up from the Gardena to Carroll's woods, both of which were mads rallying points.

A young man named John Horn had hn head badly cut and his left arm broken iu two places during the melee. Another young man, named George Robinson, about 19 years of age, son of watchman John Robinson, received a alug iu the back aud another in hia arm, causing painf ul if not dangerous wounds. Another young man named Hollitt, about IS years of age was also badly wounded bv a alug and a boy named Thomas Britt waa struck on the head with a stone, his flesh badly lacerated, and himself knocked down senseless His injury came near being fatal. A large number of others had their heads cot and limba injured, but not aufficient to punish them for their disgraceful participation in the fight Baltimore Clipper.
